Texas executed its ninth prisoner of 2012 today

Cleve Foster speaking with visitor threw death-row phone

Texas executed its ninth prisoner of 2012 today after death row inmate Cleve Foster, 48, failed to obtain a last-minute stay from the U.S. Supreme Court.

Foster was convicted in 2002 of helping his roommate, Sheldon Ward, kill a Fort Worth, Texas, woman and hide her body in the woods. Ward, however, wrote a death-bed note before he died in prison saying that he’d acted alone, and Foster had nothing to do with the murder.

Foster has maintained his innocence, but didn’t mention that as he was executed. Instead, according to The Associated Press, he expressed love for his family and God before the drugs took effect, he began snoring and then he stopped breathing.

“When I close my eyes, I’ll be with the father,” he said. “God is everything. He’s my life. Tonight I’ll be with him.”

He turned to relatives of his victims and said, “I don’t know what you’re going to be feeling tonight. I pray we’ll all meet in Heaven.”

Foster has been scheduled to die four times over the past year but has received three stays of execution from the Texas Supreme Court and the U.S. Supreme Court.

Foster was hoping the country’s high court would step in and give him one more stay. But instead, it cleared the way for his execution with a brief decision just hours before the lethal injection was administered at 6:43 p.m. CT.

In the following pages, take a closer look at 2012’s death row inmates — and their final statements of innocence, acceptance or praise for their beloved Texas Rangers baseball team. Their statements were recorded by the Texas Department of Criminal Justice.

Article written and published last year on January 12th, 2011 – One day after Cleve Foster’s last-minute stay:

The former Army recruiter was suppose to be executed January 11th, 2011 but had received a last-minute stay of execution from the Supreme Court. Foster was arrested, convicted and sentenced to death-row for the rape and murder of a 30-year-old Sudanese woman in Fort Worth, TX nine years prior. He had always insisted that his friend and former roommate, Sheldon Ward, who was also condemned for the killing, acting alone in the murder of Nyaneur Pal, who was shot in the head and dumped in a ditch in Tarrant County. Ward died of cancer in prison May, 2010.

Foster’s attorneys had asked the Supreme Court to stop the execution on the grounds that trial attorneys failed to get testimony from a blood spatter expert to counter a detective’s testimony that Ward couldn’t have killed and moved Pal’s body by himself.

“The state of Texas is on the verge of executing an innocent man,” attorney Clint Broden told the court.

In the court’s brief order to halt the execution, two Justices indicated that they would have allowed the punishment to proceed.

More than 60 protesters were gathered at the Texas Capitol last night. They rejoiced when they heard the news of the of the stay of execution by phone call from other protesters gathered outside the prison in Huntsville where Texas does its killing.

Foster would have been the first person to be executed in Texas this year had the stay not been granted.

Teen Murdered Former Girlfriend For ”Bet And Free Lunch”

Actual murder took place in October, 2010.

Relaxing with his girlfriend, he looks the picture of innocence. Yet not long after this picture was taken with Rebecca Aylward, Joshua Davies battered her to death.

Davies, 16, lured his ex-girlfriend to a secluded spot where he killed her to win a bet over a free breakfast.

Rebecca, 15, and her mother Sonia had both been delighted when Davies, an academically gifted boy from a  churchgoing family, arranged to meet her again.

When her daughter failed to come home, Mrs Aylward’s reaction was to tell  her sister not to worry adding: ‘She’s safe, she’s with Josh’.

By that time Rebecca had been bludgeoned with a rock the size of a rugby  ball – and Davies was trying to cover his tracks on Facebook.

He failed – and was yesterday found guilty of murder.

The chilling case highlighted how he used the internet, text messages and an array of social networking sites to plot her death.

A few weeks before the murder, one of his friends had joked that he would ‘buy him breakfast’ if he carried out his threat.

Two days before he killed Rebecca, Davies told him: ‘You may have to buy me a breakfast.’

Mr Justice Lloyd  Jones lifted an order preventing the killer from being named and photographed, saying it was in the public interest that he should be  identified.

And Rebecca’s family issued a statement at Swansea Crown Court saying their lives had ‘stopped’ on the day in October 2010 when she was murdered.

‘Rebecca was killed in a senseless and barbaric act,’ they said. ‘She died at the hands of someone she loved and trusted.

‘We will never forget what he did to her or forgive him for destroying our family.’

Joshua Davies arriving at Swansea Crown Court

Joshua Davies arriving at Swansea Crown Court. The trial heard that two days before the murder Davies texted his friend to say: ‘Don’t say anything but you may just owe me a breakfast.’

Rebecca and Davies, from Aberkenfig,  near Bridgend, met at the age of 11 and began going out together in late 2009 but the relationship soured and was ended by Rebecca after three  months.

The following  October he asked to see her again. ‘Rebecca was quite happy to meet up  with him – she thought he was going to ask her back out,’ her mother  told the court.

‘She got up at 6am to get ready and to do her make-up. She put on her new clothes, bought the day before.  ‘Rebecca sounded really happy when she saw it was him coming down the hill towards her. ”I wanted to make sure it was him so I got Rebecca to say his full name twice.’

When the couple were alone, 6ft Davies repeatedly slammed a rock into Rebecca’s head before leaving her bloodied and battered body face-down on a wet forest floor.

He then took a friend, who cannot be named for legal reasons, to the scene to show him her body.

Davies told him: ‘Do you know how hard it is to break someone’s neck? She was facing away from me and I thought, “This is it, I’m going to go for it”.

‘I tried to break her neck. She was screaming so I picked up the rock and started to hit her with it. The worst part was feeling and seeing her skull give way.’

He then updated his Facebook page saying he was at home at the time of the murder, and after Rebecca had been reported missing even expressed his own fears for her welfare.  He then made plans to return to the forest near his home on the night of the murder to bury Rebecca’s body and even attempted to pin the blame on the friend he led to the scene, using it as his defence during the trial.

Police were alerted to the killing after one of Davies’s friends told his parents and led officers to the body.

Other friends told detectives that  Davies was a ‘Jekyll and Hyde’ character who was ‘fixated’ on murder and would threaten to kill anyone who crossed him.

They said that most of the time, Davies, who lived with his shop assistant  mother Hayley and mechanic father Steven, was a confident and outgoing  schoolboy in all the top sets who dreamed of becoming Prime Minister.

But he also had a ‘dark and sinister’ side that would surface when he fell out with people and was extremely ‘jealous and possessive’ of Rebecca.

Shortly after she ended their relationship he began spreading vicious rumours  about her having an abortion and trying to get pregnant to keep him following the break-up.

He would share his threats and scheming with his friends on social  networking sites and over text messaging, using textspeak to communicate.

The jury were given a list of text sayings and symbols to help them understand the conversations between the teenagers.

Davies was obsessed with violent films and his Bebo page lists his favourites, including ‘There Will Be Blood,’ in which Daniel Day-Lewis bludgeons a  man to death with a bowling pin.

He also told friends he was going to drown Rebecca in a river or throw her off a cliff and dump her body in a hole, inspired by the violent Spartan fantasy film 300.

He said: ‘Wouldn’t it be easier if she wasn’t here? I am going to kill her – it would be real easy.’

He even bought a toxic foxglove concoction that he said he was going to put in her drink so she would ‘die in her own filth’.

But despite all the warning signs, none of his friends believed he would actually carry out his threats.

Lifting an order preventing Davies being named and pictured because of his age, Mr Justice Lloyd Jones said: ‘This is a crime in a small and closely-knit community and it’s right that the public should know there has been a conviction and who has been convicted.

‘I accept that the weight given to the welfare of the boy changes now he has been convicted of a very serious offence.’

What would you do if I DID kill her… teenage murderer’s chilling text message to friend

Joshua Davies and his teenage friends inhabited their own online world in which the line between fiction and reality often became blurred.

They would use textspeak, jargon and symbols in a language so impenetrable that the jury had to be given translations.

The apparently playful way in which the schoolchildren communicated – in sentences peppered with smiley faces and symbols – belied the sinister nature of Davies’s intentions.

Rebecca even bought new clothes for the 'date' unaware Davies had been boasting to his friends how easy it would be to kill her.

Davies bludgeoned Rebecca to death with a rock the size of a rugby ball. He later boasted to a friend and showed him the scene

In the months and weeks leading up to Rebecca’s murder, he would post messages on social networking sites including Facebook, MSN Messenger and Bebo, saying he wanted to kill Rebecca.

His friends would respond to these  sickening threats in jest, often egging him  on in the mistaken belief that he was  messing around.

But Davies was deadly serious and continued sending the messages until just days before he battered her to death in a woodland clearing.

Before he left to meet his ex-girlfriend on the day of the murder he told one friend: ‘The time has come.’

He also goes on to say: ‘What would you do if I actually did kill her?’

The friend replies: ‘Oh, I would buy you breakfast.’

Two days before the brutal murder Davies says: ‘Don’t say anything but you may just owe me a breakfast.’

His friend replies: ‘Best text I have ever had mate. Seriously, if it is true I am happy to pay for a breakfast. I want all the details. You sadistic bastard.’

The text finishes with a smiley face symbol.

The friend, who cannot be named for legal reasons, said in court that he did not believe Davies and had not known how his texts would be taken, suggesting an extraordinary disconnect between the online world and reality.

‘I didn’t mean I wanted him to kill her,’ he said. ‘I thought he was only joking so I was messing about with him.

‘I honestly didn’t think he was going to do it – I was just playing along.’

Davies posted Facebook updates saying he was ‘just chilling with my two friends’ while watching Strictly Come Dancing to imply he was at home at the time the murder took place.

He later posted the Facebook status update: ‘I enjoyed a rather good day and a lovely breakfast’, in a clear reference to the bet he had made with his friend.

And he posted his own concerned messages on Facebook after Rebecca was reported missing, suggesting he was  genuinely worried and giving her family no cause to suspect he was involved.

‘I feel sorry for her mother,’ the murderer wrote on Facebook.

When asked why, he replied: ‘Well if I was a parent I’d be worried if my daughter was missing.’

Mother Who Tortured And Killed Daughter, Nine, Sentenced 15 Years To Life In Prison

A year and a half ago Elizabeth Holloway, moved in with her mother, her mother’s boyfriend and half sister and brother.  A year and a half ago, Elizabeth began being abused by her mother.  A year and a half ago, Elizabeth was 7 and ½ years old and had no idea that by 9-years-old she’d be telling her younger sister she was dying…. and would.

Pictured; Elizabeth Holloway, Nine.

Imagine you are 7 and ½ years old and you are moving in with your mother and siblings, exciting right?  It’s a new start that includes a sister and a brother, what could be bad about that?  I’ll tell you what could be bad about that… a mother that reportedly begins to beat you as soon as you move in.

According to police reports Elizabeth lived with her father until 17 months ago when she moved in with her mother Crystal Cardenas (25).  At which time it appears she became her mother’s personal punching bag enduring numerous incidents of abuse.  In the 17 months she lived with her mother she was reportedly choked, punched, kicked, burned and thrown to the ground.  Poor thing, I just want to hug her so bad!  A few days before her death on January 17th, Crystal reportedly punched and kicked Elizabeth, causing a bruised pancreas and transection of her intestines. These injuries would have resulted in Elizabeth dying “a very slow and painful death,” according to prosecutors.  Elizabeth experienced vomiting and loss of feeling in her lower extremities.  She told her 7-year-old half sister she felt like she was going to die.  Now that statement right there just does it for me, I can not imagine the fear she must have felt at 9-years-old and literally thinking she was going to die and having NO ONE to go to.  This little girl knew she was dying… it breaks my heart!

Pictured; Crystal Cardenas, 25, setenced to 15 month’s to life in prison.

On January 17th San Diego Police were called at approximately 10:00 pm with a report of a child not breathing.  Paramedics arrived and took Elizabeth to the trauma center; she died at 11:56 pm.  The SDPD child abuse unit was originally handling her case, but the autopsy showed she died from blunt force trauma and the case was handed over to homicide.

After a thorough investigation, that included interviewing the family, extended family, neighbors, former neighbors and people at the school Elizabeth attended, the DA’s office and SDPD concluded that Elizabeth’s mother Crystal was the one who inflicted the abuse and caused the death of her daughter.

Cardenas’ other two children are under the care of CPS.

Cardenas faces 25 years to life, if convicted of murder.  The preliminary hearing is set for February 16th.

Disabled Child Decapitated: Dad was tired of caring for him

Disabled Child: Dad was tired of caring for him

Pictured: Jori Lirette was murdered on August 12th, 2011 by his father who then left his severed head on the front-yard.

THIBODAUX, LA. - A Louisiana man murdered his disabled 7-year-old son by bludgeoning, decapitating and dismembering him on August 12th, 2011. He then left the boy’s head near the street so the child’s mother would see it — a killing that brought seasoned police officers to tears, authorities said on August 13th, 2011.

Jeremiah Lee Wright, 30, of Thibodaux waived his right to an attorney and confessed to killing Jori Lirette within 30 minutes of being brought to the police station. Wright was booked with first-degree murder and held in lieu of $5 million bond.

He was in isolation due to the severity of the crime commited.

After news broke out about the horiffic crime, flowers, balloons and stuffed animals were left outside the house where Jori died. “He was maybe the best thing that ever happened to me,” his mother, Jesslyn Lirette said.

A preliminary autopsy found the boy was bludgeoned, decapitated and dismembered. Whatever hit him caused “excessive bleeding in the head.” Wright told Investigators “that he’d gotten to the point where he was tired of taking care” of the boy, who had cerebral palsy and heart problems, needed a feeding tube, had limited speech and was in a wheelchair.”

Wright also told Investigators “He said when he put his head out by the side of the road it was so the mother would see it when she came by,” Silverii said. He said Wright’s only explanation for doing so was “just that he wanted her to feel stupid when she saw the head.”

Jori’s feet and one hand also were cut off, recovered with the body in several white plastic garbage bags. The slaying was the first in Thibodaux since 2008.

The boy was decapitated over the kitchen sink, which was sent to the Louisiana State Police crime lab along with a box of tools found nearby. Wright told investigators he began killing the boy about 30 minutes after Lirette had left Sunday to repair her pickup truck so she could take Jori to a doctor appointment later that week.

It wasn’t the first Police have been called to the house. Last month when the couple had an argument about money, neither person brought charges. Wright had been arrested a few times previously, though he was never charged with violent crimes. Wright served 10 days for theft in 2005.

Jesslyn Lirette and Jeremiah Wright had been together for 10 years, but according to Jesslyn, she had planned on leaving Wright for sometime. “I didn’t get out fast enough,” she said.

A friend of Jeremiah Wright, Mark Chatagnier, told a media that Wright was unemployed and that Lirette often left him to care for Jori, even when she was not working. “She would take off and totally expect Jerry to do everything,” Chatagnier said.

Lirette denied that. She said she cared for another disabled person to pay household bills and was still around to care for her son, who had been born three months premature, could say only a few words and weighed no more than 50 pounds when he died.

“He was my star. No matter what people think or say, he was always top priority in my life,” Lirette said through tears during a news conference. “I’ve done everything I can for him.”

When Lirette returned from fixing the truck, she found her home blocked by police tape.

When she identified herself,  they told her what happened. “These are experienced men. They came out of there in tears. Just absolutely in tears.”

Grief counselors from the Lafourche Parish Sheriff’s Office also spent time with Jesslyn.

South Thibodaux Elementary School, where Jori was a second-grader, was “a very somber place” Monday, Aug 13th, 2011, the day after Jori was murdered. Counselors were on hand there and at other schools where people knew Jori, he said. The school has 560 students, including 84 second-graders and 18 in special education across all grades.

Jori had attended South Thibodaux since pre-kindergarten, principal Diane Smith said. “Everyone loved him. Even though he could not express in words his feelings to us, he did it with his smile,” she said.

Lirette, who began her statement with a plea for privacy, ended with a message to her son:

“In Heaven I believe you’re a beautiful star and you will always shine bright inside my heart, inside everybody’s heart. If I could go back and change yesterday, I would. But I can’t.

“You will be missed and loved by everyone and we will pray every day in your honor. Love you, Mom.”

Young Man Raped And Brutally Murdered Teen Exactly One Year Ago Today

Alyssa Otremba (Pictured Below) Was Murdered September 2nd, 2011

Alyssa-Otremba-school.jpg
A Facebook memorial page has been set up in her honor.

15-year-old Alyssa Otremba was walking home in Las Vegas after. The sophomore from Arbor-View-Highschool had gone to her friends house to pick-up a text-book so she could do homework. Sometime during her ”errand” she texted her mother to tell her she’d be home within a half an hour. She never made it home.

Police, friends and family began searching for her shortly after. She was found 1-day later by friends searching for her who happen to come across her body in a vacant lot.
The teen had been beaten, raped, stabbed to death then the killer bent over robbed the teenager of her money/possesions. If that wasn’t enough, he then decided lighting her on fire would eliminate any DNA. Well, it didn’t.

It took Investigators several days to find Alyssa’s killer. Nineteen-year-old Javier Righetti was arrested for the murder of Alyssa Otremba. He not only confessed to police, but he admitted that he has done this before.
Javier-Righetti.jpg
Pictured: Javiar Righetti

Righetti was caught after he needed some help burning Alyssa’s body Friday night. A girl who knew Alyssa says her boyfriend, Daniel Ortiz, began getting calls from Righetti at midnight on the night of the murder.

He asked Ortiz to stop by his home. That’s when Righetti confessed that he’d robbed several people that day and killed a girl in a lot. At first Ortiz didn’t believe him, thinking that his friend was just high. But he drove Righetti to a convenience store to buy matches and a container of gas.

They then drove to the vacant lot to torch Alyssa’s body. That’s when Ortiz told Righetti he was going to throw up and took off in his car. He refused to answer Righetti’s calls from then on.

Righetti He’s had run-ins with the police before, and detectives apparently arrested him after a tip. Possibly from Ortiz.

Alyssa didn’t know Righetti and her sexual assualt and murder was a random act from a cruel young man who will now spend the rest of his pathetic, lonely life in jail while Alyssa is resting in peace.

Woman Tortured, Raped, Killed and Dismembered By Friend She Trusted

Brittany Killgore

Brittany Killgore (Pictured) Was Murdered On April 13th By A ”Friend” She Trusted

Brittany Killgore, age 22, from Fallbrook, California was A wife of U.S Marine Lance Corporal Cory Killgore who was deployed in Afghanistan, filed divorce three days before her murder in April, 2012. She was planning on moving back to her parents who lived in Missouri and had already packed all her belongings.

On April 13th, 2012 Louis Perez, 46, came to her home unexpectedly and told her he wanted to take her out on a surprise dinner-cruise. Brittany knew Louis as a friend and trusted him and willingly went along. Little did she know, she was about to become a victim in his sadistic fantasy.

Louis was angry at Brittany, unbeknownst to her, for refusing to participate in a sex-bondage ‘game’ with him and his two sex-partners, Dorothy Maraglino and Jessica Lynn Lopez, whom he shared a house with. The group was in a master sex-slave ring unbeknownst to Brittany who had no idea that the man she trusted was about to forcefully make her a ‘slave’ in part of his sick act.

Perez lured Brittany to his car under the pretense of ”helping her pack”. She willingly got in his car, not thinking that her ”friend” had a secret life that he was about to forcefully expose to her.

She was then brought to his house, kept against her will, tied up, and had duct-tape placed on her mouth to muffle her screams. What happened next was horrific and cruel.

The group violently raped her in what one would call a ‘sadomasochistic torture session’. They used S&M sex-‘toys’ including whips and a stun-gun which Police would later find at the house the three resided in. Police also said Brittany’s blood and hair were found on numerous S&M items located in Perez’s home. Also located was a handbook titled ”Sex Rules” which listed some of the sadistic things they do and expect their victim to do.

During the torture session the group also mutilated Brittany, when they were done they killed her, dismembered her and placed her remains in a Ditch In San Diego, CA.

Articles written back in April made false assumptions claiming Brittany willingly participated in the sex-game, not knowing it would get out of hand. Those rumors are false. Brittany was not into S&M sex and would park-take in such an act.

After hearing about the disappearance of his wife, Lance Killgore flew back from Afghanistan. I’m not sure if he knew at the time that Brittany Killgore had just filed for divorce three-days prior.

Love Triangle Killers Won’t Face Death Penalty For Burying Former Flame ALIVE

Love Triangle Killers Won't Face Death Penalty For Burying Former Flame Alive

Brandy Stevans-Rosine (Inset Top: Ashley Barber, Bottom: Jade Olmstead. )

__________

Article Published August 29th, 2012

→ Ashley Marie Barber, 18, and Nicole “Jade” Olmstead, 20, were arraigned in Crawford County on August 24, 2012, for the murder of Brandy Stevens-Rosine, a student at Youngstown State University, and Olmstead’s former flame. The couple confessed to the murder at a preliminary hearing in July, revealed the gruesome details of the brutal murder to the court.

On May 17, 2012, Stevens-Rosine went to visit her ex, Olmstead, at the home she shared with her new partner, Ashley Marie Barber, 20, in Wayne Township. The couple lured her into the woods, kicked and beat her, strangled her — but not to death. Barber then head butted her, Olmstead beat her on the head with a shovel until her brains spilled out, and they repeatedly smashed her head against a stump. When they realized that Stevens-Rosine was still breathing the women bashed her face in with a large rock and poured water into her mouth and nose to drown her. Ultimately they buried her alive in the shallow grave prepared beforehand. The coroner’s report concludes that Stevens-Rosine died from asphyxia caused by dirt in her airway consistent with having been buried alive. Reports thus far have not mentioned how long the attack lasted, or how long Stevens-Rosine’s suffering would have lasted. The motive for the murder is also not clear. Both women are charged with one count of criminal homicide, conspiracy to commit criminal homicide and tampering with physical evidence. If convicted they will face life in prison without the possibility of parole — but not the death penalty.

District Attorney Francis Schultz decided, “after careful consideration of the law and the facts that have been uncovered in the investigation of this case,” not to ask for the death penalty in this case, he added that though the murder was “brutal,” the allegations did not meet Pennsylvania’s criteria for the requesting the death penalty: Murder in the first degree with at least one of 18 possible aggravating factors. Schultz stated that a first-degree murder case might qualify for the death penalty if the “offense was committed by means of torture.”
